TERMS AND CONDITIONS OF CONTRACT
FOR "PAKISTAN BRAIN BANK" SERVICES (PBB)
Services means the process of placement of customers CV's
in the local as wellas in international market as acquired by
the customer or according to the registration fee.
Account validity means the period of the validity of the
registration.
Customer means the customer named overleaf.
The customer shall be entitled to utilize the services for
the duration and to the extend of the account value paid by
the customer.
Any applicable taxes, duties, charges or other cost which
may become payable from time to time in accordance with
legislation as Govt. or other authorities instructions or as
a result of charges in the policies as cost of services provided
by PBB.
The account validity period shall vary in accordance with the
time and shall be stated thereon.
The customer hereby acknowledged that the registration shall
be automatically terminated if found guilty in any court of law
in Pakistan.
This contract shall commence on the date of its execution by
the customers and unless terminated earlier in accordance with
the provision hereof, shall remain valid for a minimum period
of one year from the date of registration and there after until
terminated by either party giving the other, at any time after
the expiry of the initial validity period, not less then three
months notice in writing. PBB may in its absolute discretion
charges an annual fee for the renewal of the contract one month
after the expiry of the initial validity period by debiting at
any time the current account value of the customer where no
notice of termination has been received by PBB with in the
fifteen days of expiry of the initial validity period.
For international market customers PBB will make the
appropriate entry in any website of jobs.It may entered time to
time free of charge in the validity of registration.
PBB will not accept any liability for incorrect or omitted
entries in any website. PBB will responsible if the employee
within the validity of registration receives no call.
PBB reserves the rights to send your CV's at any place in
Pakistan as well as in international market in the validity
of registration.
This agreement is personal to the customer and the benefits
or liabilities hereof may not be assigned to any one else without
the written consent of PBB.
PBB may at any time assigns its rights under this contract to
any third party.
PBB shall not be liable to the customers for any loss, expense,
or damages of any kind, including consequential loss or damages with
the performance of its obligations under this contract or for
delayed or defective performance or failure of performance or
arising from suspension or malfunction of the services for
whatsoever reason and Pakistan Brain Bank shall not be deemed to
be in breach of contract an account of any of the forgoing reason.
PBB shall not be in any event be liable for any loss to the
customer for failure of the services on an account of the act of
the Employer's.
PBB shall not be liable to make any refund to the customers for
suspension or malfunction of the services or for whatsoever reason.
PBB reserves the rights to issue such instructions concerning
the use of the services as it may from time to time consider
necessary to mention the quality of the services for all customers.
PBB may vary the conditions of this contract as a result of any
applicable instructions of the Govt. agency or department upon
reasonable prior notice.
All information contained in PBB's promotional material,
advertisements and publicity campaigns is for the information
only and shall form part of any contract between PBB and the
customer save as expressly provided therein. The customer
acknowledges that he has not relied on as been induced by any
such material in entering in to this contract.
No warranty condition, undertaking as term
(whether implied or expressed) as to the nature of services
or service level shall be part of any contract b/w PBB and
customer and no such term shall be implied by law or otherwise.
Job placement in the international market is respect to the
availability of the jobs in our list in any country of the world.
PBB is not responsible for the visas and arrangements of
immigration of any customer.
International market also consists of online job placement on
the Internet while staying in Pakistan or in homeland.
The contract comprised by these conditions and particulars shown
in printed registration form shall constitute the entire contract
b/w PBB and the customer. All services provided by PBB are subject
to these conditions and none other, and any other terms, conditions
or provisions proposed by the customer either orally or in writing
shall be of no effect.
The failure or delay by PBB in exercising any option, right
or remedy under this contract or to demand compliance of any
obligation of the customer shall not constitute a waiver of any
such option, right or remedy, or the performance thereof.
The decission of the Judges would be considered final for the
distribution of Prizes, and that decission would not be challenged
in any case.
